An Emergency Medical Technician (EMT) at the Peebles Hospital will no longer have to face charges of assault after his ex-wife testified that she wants the charges to be dropped against him.
Will Smith was charged with assault occasioning actual bodily harm, threatening language and criminal damage.
Today, June 15, his ex-wife Tracia Smith took the witness stand and stated that she would like to withdraw the complaints against her ex-husband.
According to her, since the divorce was filed, he became angry and she feared for her safety. However, she said the complaint has resulted in her getting a restraining order; hence, she is satisfied that is now in place.
Tracia Smith said they share three children and after the divorce, the family went their separate ways and it took a toll on the children.
She told the court that after the choking incident on October 16, 2011 at the Little Apple Bay residence, there has been a conflict between the children and one child is not speaking to the father. According to her, the youngest child is still traumatized by the incident, but the relationship with the father is reforming.
Tracia Smith, who is a Health Information Officer, stated that she hopes the father and all three children will have a renewed relationship.
Prosecutor Janice Stoutt said based on the evidence given by Tracia Smith, the crown wishes to offer no evidence against Smith in the case.
Senior Magistrate Valerie Stephens then dismissed the charges and told Mr. Smith that as a family man, he should not have an altercation with his wife in front of their children.
Smith's lawyer, Richard Rowe then briefly stated that his client was trying to defend his son who was being beaten by the mother at the time of the incident.
If someone has done something wrong then the DPP should contimue the prosecution, If wrong is done it is done and should be penalised.
If it is not other innocents will suffer in the future.
